  1. INTERPRETATION
    • In this document, unless the context clearly indicates a contrary intention, the following terms shall have the meaning as defined in this clause apply:
      • Business Day” means a day other than a Saturday or a Sunday or a day which from time to time is a proclaimed public holiday in the Republic of South Africa;
      • Campaign” means the promotional campaign to which these rules pertain as run by the Promoter during the Campaign Period
      • Campaign Period” means the period starts on 00:00 1 April 2022, and closes at 00:00 30 May 2022. No late entries will be accepted under whatsoever circumstances;
      • CPA” means the Consumer Protection Act, 68 of 2008;
      • Participant” means an individual who enters the Campaign and meets the criteria set out in any natural person who qualifies in terms of clause 1;
      • POPI” means the Protection of Personal Information Act, No 4 of 2013;
      • Promoters” means, collectively, OPPO South Africa and Vodacom;
      • Prizes” means as further described in clause 6;
      • Rules” means the rules contained in this document, as required by Section 36 (3) (c) of the CPA; and
      • Winner” means a Participant who is successful in the Promotional Campaign and is notified as such by the Promoter in terms of clause 7.
  1. INTRODUCTION
    • This Campaign is jointly organized by the Promoters.
    • The Promoters are offering Prizes for the qualifying Winners under the terms and conditions as set out in this Rule.
  2. CPA
    • This Rule is a public document and may also be made available upon request.
    • By entering into the Campaign, the Participants agrees and acknowledges that he/she has read and understand the Rules as the Rules contain certain terms and conditions which may:
  • limit the risk or liability of the Promoters, or any relevant third party; and/or
  • create risk or liability for the Participant; and/or
  • compel the Participant to indemnify the Promoter or a relevant third party; and/or
  • serve as an acknowledgement by the Participant of certain facts.
  1. PARTICIPANTS
    • The Participant, by entering into the Campaign, expressly acknowledges that:
  • he/she has been given an appropriate opportunity to first read the Rules before entering the Campaign and that he/she understands and thereby agrees to the Rules;
  • it is the Participant’s own responsibility to ensure that in the event that he/she is selected as Winner, he/she will comply with all COVID 19 restriction as may be imposed by South Africa and/or United Kingdom in order to enjoy the benefit of the Prizes and Participants irrevocably and unconditionally indemnifies the Promoters for any expenses, damages and/or costs of whatsoever nature suffered or may be suffered by the Participant as result of non-compliance of this clause (b).
    • It is a material term of the Campaign that all Participants to this Campaign participate (including while enjoying the benefit of the Prizes) entirely at their own risk.
    • No director, employee, agent or consultant of the Promotor(s), or their spouses, life partners, business partners or immediate family members, or the supplier of goods and services in connection with this Campaign may participate in this Campaign.
  1. HOW TO PARTICIPATE
    • All qualifying Participants will automatically enter the Campaign and stand a chance to win the Prizes if he/she:
  • Upgrade or sign up to Reno 7; or
  • Purchases a Reno 7 device;
  • During the Campaign Period from or at a Vodacom Distribution Channel.
  1. PRIZES
    • Once in a life-time Wimbledon game experience which include:
  • 2 (two) airfare ticket from South Africa to United Kingdom (one ticket for the Winner and one ticket for the Winner’s nominated partner). The airline will be selected by the Promoters at their sole and absolute discretion, notwithstanding that consultation will be performed with the Winner and the Promoters prior to the booking of the airfare, Promoters cannot guarantee the date and time of the flight (save that it will be in time for Participant to enter the game as contemplated in clause (c));
  • 4 (four) star hotel accommodation for 2 (two) sharing ( for the winner and Winner’s nominated partner). The hotel (including the brand and location) will be selected by the Promoters at their sole and absolute discretion; and
  • 2 (two) tickets to a Wimbledon match (one ticket for the Winner and one ticket for the Winner’s nominated partner). The game and the seat will be selected by the Promoters at their sole and absolute discretion.
    • Save for clause 8 (e), the Prizes are personal and non-transferable. No cash alternative or other Prize alternatives are available unless otherwise decided by the Promoters at their sole and absolute discretion
  1. WINNER
    • There will be One (1) winner selected by random draw to be performed by the Promoters. The Winner will be notified by email or telephone within 2 (two) days of being selected.
    • By participating in the Campaign, the Winner hereby accepts and agrees:
  • that he/she will create an account with his/her Reno 7 and post, while on the enjoying the benefit of the Prizes, and tag Promoter’s handlers (#OPPO and #Vodacom); and
  • that the Promoters may, without any form of further compensation, incorporate the Winner in publicity campaigns or allow his/her (including the Winner’s nominated partner) names and likenesses to be used for promotional purposes aligned with the Promoter’s business, including but not limited to posting photos to the Promoters’ website, Facebook, and other social media pages.
    • In order to qualify as Winner and claim the Prizes, the Participant (and his/her nominated partner):
  • are required to provide their full names, passport numbers and contact details (including any supporting document (certified or otherwise) as may be required by the Promoters) to the Promoters within the timeline prescribed by the Promoters, a natural person and may not be a juristic person;
  • 18 years or older;
  • in possession of valid South African passport which is valid for a period of not less than 6 (six) months counting from the date upon which the Prizes are award; and
  • must not have a criminal record that would in any way affect the Participant’s ability to receive and/or enjoy the benefit the Prizes
    • The Winner (and his/her nominated partner) is solely responsible for applying their own VISA for the purposes of enjoying the benefit of the Prizes. Participants’ attention is drawn to the fact there are currently 6 (six) weeks backlog in the application of VISA to United Kingdom, in the event that the Winner (and his/her nominated partner) is aware that he/she will not be able to receive his/her VISA on time for the scheduled Wimbledon match on time, the Winner may elect either:
  • attend the trip, in which event, excluding the Wimbledon game; alternatively
  • not attend the trip at all, in which event the Winner will be paid out R100,000.00 (inclusive of VAT, if applicable) in lieu of the Prize.
    • A Prize may not be awarded to a Winner if –
  • it is prohibited by law for the winner to use the prize. The Winner must prove their eligibility to use the prize. Once the Winner has been notified and the prize has been handed over, the Winner must sign an acknowledgement of receiving the Prize; and/or
  • said Winner is a director, employee, agent or consultant to the promoter or any other person who directly or indirectly controls or is controlled by the Promoter; and/or
  • said Winner is a supplier of goods or services in connection with the Campaign.
    • In the event that the Promoters unable to award the Prizes to the Winner due to Winner’s failure to comply with clauses 3 and/or 7.4 and/or 7.5, the Promoters may, at its sole and absolute discretion:
  • Announce alternative Winner for the Campaign; or
  • Announce there are no Winners for the Campaign;

In which event the Participant irrevocably and unconditionally waive any right it may have against the Promoters.

  • The Participants’ consent, by taking part in the Campaign to the Promoter using the personal information collected through the Campaign for the purposes of selecting the Winners and for future marketing purposes by the Promoters themselves.
  • Any extras not included in the Prize as detailed above will be at the expense of the Winner.
  1. RULES
    • In addition to what’s contained in the Rule, Participants’ attention is draw to the following:
  • Any images submitted in connection with the Campaign will be displayed on various Promoters’ social media pages.
  • By entering the Campaign, Participant agree that images may be broadcast via digital feeds or printed for physical events and further that these images can be used for marketing and promotional material and activities by Promoters during and beyond the Campaign at its discretion and as is required.
  • Participant grant to Promoters, its affiliates and sub-licensees, a non-exclusive worldwide, royalty-free license to use, copy, display publicly, distribute, modify and alter any materials, including without limitation video/text/photo material posted in connection with the Campaign (to the extent not assigned to Promoters as set out herein), with the right to sublicense and assign the foregoing rights. Each Participant hereby represents that they own all rights to materials, including without limitation video/text/photo material, submitted in connection with the Campaign.
  • the Participants must provide correct and up-to-date personal details as required by the Promoter and allow the Promoter to process such information in terms of POPI;
  • the Promoter reserves the right to unilaterally amend or terminate this Rule at any time, with or without reasons, at their sole and absolute discretion. In such event, where the Campaign is terminated or suspended, all Participants agree to waive any rights that they may have pertaining to the Campaign and acknowledge that they have no recourse against the Promoter, their employees, agents, partners, suppliers, or sponsors;
  • in the event of a dispute, the decision of the Promoter will be final and binding and no correspondence will be entered into. In this regard and for further clarity, the Promoter shall be entitled to deal with such disputes (or any failure by Participants to follow the rules) in their sole discretion, including that the Promoter shall be entitled to immediately disqualify Participants from the Campaign;
  • Unlawful, fraudulent, or otherwise dishonest conduct or any conduct in breach of these Rules by a Participant and/or their parents/guardians, determined in the Promoter’s sole discretion, may result in disqualification from the Campaign and ineligibility to win any prize;
  • In the event that the Winner cannot enjoy the benefit of the Prizes due to COVID 19 related restrictions, Promoters will pay the Winner the value of the prize, not exceeding R100,000.00 (inclusive of VAT, if applicable)
  1. INDEMNITY
    • By entering the Campaign, the Participant expressly agrees to the following indemnifications:
  • the Participant indemnifies and holds harmless the Promoter and its promotional partners, their employees and their agents (“the Indemnified Parties”) of any and all liability pertaining to any damage, cost, injuries and losses of whatsoever nature and howsoever arising as a result of their participation in the Campaign and related events and activities, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation or invasion of privacy; and
  • the Participant accepts that the Indemnified Parties will not be responsible for any costs, damage or otherwise, howsoever incurred by the Winner subsequent to claiming the Prize.
  1. POPI
    • Any personal data relating to the Winner or any other Participant will be used solely in accordance with CPA and POPI and will not be disclosed to a third party without the Participant’s prior consent.
    • This Campaign is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other Social Network.
    • The Participant by part taking in the Campaign consents to his/her personal information to be shared with the Promoter’s employees, contractors or agents for the purpose of this Campaign and for the purpose of sharing future promotions.
